These Terms of Use (the “Terms”) form a legally binding agreement between you and Lake Norman Living (the “Site,” “we,” “us,” or “our”), the operator of mylakenormanliving.com. By accessing, browsing, or otherwise using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Disclaimer, each of which is incorporated here by reference.

If you do not agree to these Terms in full, you must immediately discontinue all use of the Site.

The Site is an independent editorial and informational publication about the Lake Norman region of North Carolina. It is not a real estate brokerage, multiple listing service, law firm, lending institution, appraisal firm, home inspection service, insurance producer, tax advisor, or investment advisor, and nothing on the Site creates any agency, fiduciary, brokerage, attorney-client, or advisory relationship between you and us.

All content — including community profiles, price ranges, market commentary, school information, amenity descriptions, dock and permitting notes, dining and recreation information, journal articles, images, and maps — is published for general informational and editorial purposes only. It is not an offer, solicitation, appraisal, valuation, or recommendation to buy, sell, lease, finance, or invest in any property or service.

We make good-faith, commercially reasonable efforts to compile accurate and current information from sources we believe to be reliable. Despite those efforts, real estate markets, community rules, HOA dues, school assignments, tax rates, business hours, marina operations, permitting requirements, lake levels, and municipal boundaries change frequently and without notice, and public and third-party data sources contain errors.

We therefore make no representation or warranty of any kind that any information on the Site is accurate, complete, current, reliable, or suitable for any purpose. Any figures, statistics, price ranges, square-foot costs, dates, distances, depths, rankings, or descriptions are approximations and estimates only, and may be materially incorrect. Images may be illustrative, stylized, artistically rendered, or representative of the region rather than depictions of specific properties, homes, or locations.

You must independently verify all information with the appropriate licensed professional or official source before relying on it or making any decision. We expressly disclaim liability for any error, omission, inaccuracy, or outdated statement appearing on the Site, whether or not we were aware of it.

You must be at least 18 years of age and legally capable of forming a binding contract to use the Site. You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:

• scrape, harvest, crawl at abusive rates, mirror, frame, or bulk-copy the Site or its content;

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAKE NORMAN LIVING, ITS OWNERS, OFFICERS, CONTRIBUTORS, CONTRACTORS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PROPERTY VALUE, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT ON IT — INCLUDING ANY DECISION MADE IN RELIANCE ON INFORMATION PUBLISHED HERE — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00). These limitations are an essential basis of the bargain and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Lake Norman Living and its owners, officers, contributors, contractors, licensors, and affiliates from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or third-party right, or any decision or transaction you undertake in reliance on Site content.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. The exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction there.

Binding arbitration and class-action waiver. Except for claims seeking injunctive relief for intellectual property infringement or claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms or the Site shall be resolved by final and binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Mecklenburg County, North Carolina. You and we each waive the right to a jury trial and the right to participate in a class, collective, or representative action. Any claim must be brought within one (1) year after it arises or it is permanently barred, to the extent permitted by law.

We may modify these Terms at any time by posting a revised version with an updated effective date; your continued use of the Site constitutes acceptance of the revised Terms. If any provision is held unenforceable, it shall be modified to the minimum extent necessary and the remaining provisions shall remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the Site.

Formal legal notices, takedown requests, privacy requests, and accessibility reports must be submitted in writing to the publisher of Lake Norman Living. Because we do not maintain a public inbox on this Site, notices should be delivered through the channel identified in the applicable policy or by written correspondence to the publisher of record.
